On March 8, 2013, US Citizenship and Immigration Services (USCIS) released a newly revised Form I-9. Revisions to the form include new fields for foreign passport information, email addresses, and telephone numbers, reformatting expanding the form to two pages designed to reduce errors, and clearer instructions for both employees and employers. There are no changes to the lists of documents accepted for proof of identity and work eligibility.

As of March 8, 2013, employers should begin using the new form for all new hires and reverifications. The previous edition of Form I-9 may be used through May 7, 2013 while employers update their business processes. After May 7, 2013, the previous edition of Form I-9 may no longer be used.

We remind employers that they should have a Form I-9 for all employees hired after November 6, 1986. Note, however, that employers should not complete new Forms for exiting employees for whom a properly completed Form I-9 is already on file. Unnecessary verification may violate antidiscrimination provisions of the Immigration and Nationality Act.
